Ellison files suit against Trump Administration alleging unlawful K-12 school funding conditions

(ST. PAUL, MINN) – Minnesota Attorney General Keith Ellison is leading a lawsuit against the federal government relating to K-12 school funding.

The suit says the Department of Education is threatening to withhold federal funding from state and local agencies that refuse to abandon lawful programs and policies that promote equal access to education in K-12 classrooms across the nation. Minnesota receives roughly $530 million in financial support from the Department of Education.

The states in the lawsuit assert that the Department of Education’s attempt to terminate funding based on a misinterpretation of TItle VI ‘violates the Spending Clause, Appropriations Clause, the separation of powers and the Administrative Procedures Act.’
