Horace homeowners file lawsuits against City of Horace

(HORACE, ND) – Flag Family Media has learned that several homeowners in Horace have filed lawsuits against the City of Horace relating to special assessments.

The homeowners, represented by Fargo law firm O’Keeffe, O’Brien and Lyson Attorneys, claim their special assessments ‘are extraordinarily high,’ and could be cause for foreclosure on their new homes.

Court filings detail the specifics of what errors and violations of North Dakota law the homeowners believe the City of Horace should be responsible for – including how the City neglected to notify the new home buyers of the special assessment processes.

The suit asks the courts for a total of six reliefs from jury trials, including a declaration that the current special assessments be deemed void and illegal in state law.
