(BISMARCK, ND) – The North Dakota Supreme Court has sided with a district court in a case involving a sitting North Dakota legislator.
Mitchell Sanderson, of Park River, brought action against state senator Janne Myrdal in May 2023, accusing the senator of violating his First Amendment rights by blocking him on Facebook.
The high court said the district court made the correct rulings in the dismissal of the claims by Sanderson.
“The court concluded that Myrdal’s blocking of Sanderson cannot be construed as state action, because Myrdal acted in her private capacity when she did so; Myrdal has no authority to act on behalf of the State in the administration of her Facebook page,” the ruling said.
